These Terms of Service govern your use of the ConsignYourBoat website and consignment brokerage services. Please read them carefully before submitting a valuation request or entering into any consignment arrangement with us.
By accessing or using ConsignYourBoat.com (the "Site") or engaging any of our consignment brokerage services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site or our services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.
ConsignYourBoat provides licensed marine consignment brokerage services, acting as agent on behalf of vessel owners ("Consignors") to facilitate the sale of watercraft. Our services include but are not limited to: vessel valuation, professional photography, marketing, buyer qualification, sea trial coordination, marine survey management, and escrow closing. ConsignYourBoat does not purchase vessels outright; we act solely as the Consignor's agent.
A formal written Consignment Agreement must be executed prior to the listing of any vessel. The Consignment Agreement will specify the listing price, commission rate, listing duration, and all applicable terms. The Consignor warrants that they hold clear and marketable title to the vessel, free of undisclosed liens, encumbrances, or legal disputes. ConsignYourBoat reserves the right to decline any vessel for consignment at our discretion.
ConsignYourBoat operates on a commission-only basis. No upfront fees, listing fees, photography fees, or marketing charges are assessed to the Consignor. Our brokerage commission is a percentage of the final sale price, as specified in the signed Consignment Agreement. The commission becomes due and payable exclusively upon the successful closing of a vessel sale. No commission is owed if the vessel does not sell during the listing period.
All sale proceeds are handled through a licensed marine escrow account in accordance with applicable state and federal regulations. Title to the vessel transfers to the buyer only upon full clearance of funds. Upon successful closing, the net proceeds (final sale price minus agreed commission) are disbursed to the Consignor via bank wire transfer, typically within the same business day as closing. ConsignYourBoat is not responsible for delays caused by banking institutions or third parties.
The Consignor represents and warrants that all information provided regarding the vessel (including year, make, model, length, engine hours, condition, and any known defects) is accurate and complete to the best of their knowledge. Misrepresentation of vessel condition may result in termination of the Consignment Agreement and/or legal liability. ConsignYourBoat is not responsible for undisclosed defects discovered after closing.
ConsignYourBoat facilitates buyer-requested marine surveys and sea trials as part of the standard sales process. The Consignor agrees to make the vessel available for such inspections upon reasonable advance notice. All costs associated with buyer-requested surveys and haul-outs are the responsibility of the buyer unless otherwise negotiated in the purchase agreement. ConsignYourBoat makes no representations regarding the findings of any independent marine survey.
ConsignYourBoat retains the right to photograph, video, and market the listed vessel across all platforms and channels deemed appropriate, including but not limited to YachtWorld, Boat Trader, Boats.com, our website, social media, and our private buyer network. All marketing materials created by ConsignYourBoat remain the intellectual property of ConsignYourBoat. The Consignor grants ConsignYourBoat a non-exclusive license to use vessel images and descriptions for marketing purposes during the listing period.
Either party may terminate the Consignment Agreement in accordance with the notice provisions set forth in the signed agreement. If a Consignor sells the vessel independently during the listing period to a buyer introduced by ConsignYourBoat, the full brokerage commission remains due and payable. ConsignYourBoat reserves the right to terminate a listing for cause, including but not limited to misrepresentation, vessel unavailability, or breach of the Consignment Agreement.
To the maximum extent permitted by applicable law, ConsignYourBoat shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services or this Site. Our total liability to any Consignor or buyer shall not exceed the commission or fee amount paid in connection with the specific transaction giving rise to the claim. We are not liable for acts of third parties, including but not limited to buyers, marine surveyors, escrow companies, or financial institutions.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Broward County, Florida, and both parties consent to the exclusive jurisdiction of such courts.
